to review documents taken from his home in florida by federal agents last month. a judge came down in favor of the trump team's request today rejecting arguments from prosecutors that the special master was both unnecessary and unwise. correspondent david spunt has tonight's top story. good evening, david. >> this judge's order out hours ago is a temporary legal victory for the former president and gives him more political opportunities to attack an ongoing grand jury investigation into his handling of sensitive documents. >> days after asking what is the harm with naming an outside neutral party to review the thousands of documents seized by the fbi, judge aileen cannon cited unprecedented circumstances in ordering the special master, quote: to review the seized property for personal items and documents and potentially privileged material subject to claims of attorney-client and/or executive privilege. the judge's order still allows

the intelligence community to continue its risk assessment of the seized material. but the government for now may not use the documents for investigative purposes. as part of the grand jury criminal probe. the judge noted those records include medical documents, tax related correspondence and accounting information. >> the fbi and the justice department have become vicious monsters. controlled by radical left scoundrels. >> days after the search, trump told fox news digital he will do whatever he can to help the country, insisting, quote: the temperature has to be brought down. the justice department in a statement said it would consider appropriate next steps but did not indicate whether it would appeal, perhaps ultimately to the supreme court. doj officials argued a special master was unnecessary since federal prosecutors already completed the review of material, possibly covered by attorney-client privilege. but the judge's order allow for review of possible executive

privilege as well. raising constitutional questions over whether a former president can keep sensitive classified documents from the current administration. >> they have been narrowly along conducting their investigation with the agents assuming all these documents were appropriate for the investigation. now, the judge is saying hold everything, he may have executive privilege. >> underlying all of this, the political considerations. the justice department typically does not bring a criminal case against political figures in a two months before a federal election. as for the name of the special master, that's still to be determined. the judge gave both sides until friday to come together and suggest names. bret, it could be a lawyer, a retired judge, even an intelligence official just not directly related to the case. >> bret: the reason an intelligence official potentially because they have to have clearance to deal with some of those documents? >> clearance at some of the highest levels. probably top secret clearance because you are dealing with hundreds of pages of documents and this is a special master that's individually going to go

consecutive conservative u.k. prime minister. background of other cabinet post and some shifting positions. like being against britain's exit from the european union until it was approved and then favoring it. >> she needs to show that she actually understands and can meet the challenges that are there after 12 years of failure of this government. >> truss is also known for speaking her mind like when she said last month the jury is out as to whether france's president emmanuel macron is a friend or foe. the french leader reacted today. >> i expressed to her that france can graduate late her and we are available to work as allies and friends. >> person truss most admires is former u.k. prime minister margaret thatcher, may be a good thing for the u.s. she has been a strong supporter of ukraine and its fight against russia and ardent critic of chinese president xi jinping and authoritarian policies despite questions u.s. lawmakers have about her handling of northern ireland post brexit. >> proves to be a very dependable partner for

wearing a white shirt with a bow on the front and she said the iron lady was a bit relentless. she -- what about liz truss and what americans need to know about the new prime minister? >> i'm hopeful. bret. 650 seats the tories control 357 and the a few more from the union nationalist from northern ireland. she got a huge majority. which she has got to use. and she has viewed to use and very quickly. staff her government by tomorrow night. going to slap a freeze on energy prices for every one of the 28 million households in great britain. and she is going to unleash energy production by removing a ban on fracking, stand strong with ukraine. put the nuclear submarines in the process of procurement. if she moves as fast as maggie thatcher did. we will all, the whole world will be better served for a very exciting time in great britain. >> bret: morgan? >> yeah. i had the privilege of

interviewing her in 2018 in d.c. i thought she was incredibly charismatic. very bright. i knew she was going to be a star. i didn't know how quickly it would be. i don't know how much i would give into the maggie thatcher comparisons or not. what she has to do is be a good prime minister and in the face of some enormous headwinds. you are looking at double digital inflation potentially in the u.k. as hugh just said you are looking at energy crisis potentially in europe as well that they're going to face this winter. so she is going to have a lot of external factors. one of the things that i can think we can look forward from the u.s. perspective that she could do immediately is to really slow down these iran negotiations that the e 3 that is england, germany, france, they are a part of. she could really put a stop to some negotiations that i think have been quite dangerous for american national security. >> bret: jeff, this white house, it's interesting. the financial times had a piece out which it said inside liz truss' not so special relationship with the u.s. beneath a veneer of solidarity.

truss has at times issued her american counterparts. truss' thatcher won her many supporters in republican foreign policy circles. while she is not short of fans on the right, friction with democrats. nancy pelosi was deeply concerned by the u.k. government's intention to discard the post brexit northern ireland protocol. truss said she would not bow to the pressure. i will be very clear with people like nancy pelosi exactly what i think about this and exactly what we gheed to do. this relationship obviously is very special and important to the u.s. what's the biden administration's take? >> well, i think the biden administration is likely looking forward to continuity with the u.k. and looking forward to working with her. sure there will be some points of disagreement. but that's true with any ally. i think, in general, that the -- some of the challenges that she faces in the u.k. are the same challenges that president biden faces in the united states. inflation being one of the top ones. and their positions on the war

plant. we go back to the semi-fascist slur. then we go forward to the student loan bailout. and forward to the red setting. the red wedding speech which was a much panned by everyone who was objective about it and today you have the wisconsin and democratic senator candidate not showing up with the president like tim ryan in ohio. they don't want to be anywhere near him e has 38% approval. it's falling. he can always get a crowd. he is the president of the united states. people want to see him. people don't like him some union guy also show up, et cetera. it's been a disastrous starts to the labor day campaign and talk later specific races i think. right now you would rather have the republican cards and the democratic cards and rather be led by mitch mcconnell and kevin mccarthy than joe biden. >> you saw president biden live there on the ground in pennsylvania. taking pictures with a lot of union guys. morgan, the former president had a legal victory today talk about that in a second. as president biden gets on the

trail and says that former president trump is a threat to democracy, today on truth social the former president said this: now that the fbi and doj have been caught in a massive and determinative election rigging scam, are they going to change the results of the 2020 presidential election? they should. is the former president giving ammo to the current president on the campaign trail with posts like that? >> yeah. it's probably not the most helpful thing he could tweet. going into the midterms and it's clear that the biden team tries to use those type of statements and to do whatever they can to attach president trump to the midterms. that's the whole strategy. but, i think what we have to focus more on is the speech that hugh just talked about and how the president and his team have made a calculated decision to motivate by hate. they have made a calculated decision to divide this country

pirnd should know look at the members of the military. most of the members of the military are registered republicans who probably voted for trump. are you trying to say people who sign up to give their lives for this country are a threat to the republic? it was one of the most insulting and demonizing things that i have ever seen a president do to half the country. and i find it to be very chilling. if this is how they have to motivate their base because 70% of disapprove of the country we are in for dark, dark days from the biden administration. >> bret: the white house secretary fielded a lot of questions about that speech. the president took one from our own peter doocy. they are all in, aren't they on this campaign pitch and this is how it's going to go heading into november? >> absolutely. i think they are all in. and the president's message, whether it was came or arrived well with some part of the country or not was certainly that he thinks trump and trump

supporters are a threat to american democracy. the president or the white house argued that that wasn't a political speech. i think that's been a tough argument for them to make. that said, i think it's something that the president believes deeply and to get back to your question to morgan just now, when the former president on his social media platform says the fbi or the doj should turn over the election, it just shows a fundamental misunderstanding of what the constitution allows the fbi and the doj to do. and it shows where his head is about democracy and i think it absolutely gives fodder to president biden. i think he will use it. >> bret: quickly, hugh, a big win for the trump legal team today, a special master being appointed after all the pundits everywhere were saying there is no way this is going to happen. it happened. >> judge cannon is a graduate at high law school. if harold was on we would be talking about university of michigan putting another good judge on the bench. the key part of the ruling is this is unique circumstances. documents have been seized from a former president of the united

>> bret: breaking tonight canadian police say one of two men wanted to fatally stabbing at least 10 people in indigenous community in a nearby town has now been found dead. authorities say damion sanderson did not kill himself. the other suspect, his brother may be injured and remains at large. 18 people were injured in those attacks some were targeted others appeared to have been coach at random. officials have given no motive for these crimes every police presence near a creek about six

miles from where a missing mother of two children was last seen. such for aliza fletcher continues tonight. alleged abductor identity theft, he was arrested saturday after police detected his d.n.a. on a pair of sandals near where fletcher was last seen. she was on jucketted while jogging around 4:00 a.m. friday. correspondent garrett tenney is in eagle pass, texas to show us how illegal immigrants continue to come into the country no matter the obstacle, good evening, garrett. >> yeah, bret. despite 13 migrants drowning while trying to cross the rio grand late last week and despite the warnings by border patrol, hundreds of migrants are continuing to try to make this treacherous crossing of the

waters. you can see many of these groups, include young children who are used as one link in human chains to try to forge through the river. we have seen multiple people today torn away by the strong current and carried downstream until texas national guard is able to pick them up. this man was sucked under water while swimming to the guardsman's boat and disappeared for several seconds before they were able to get him a life ring and save him. meanwhile, in chicago, mayor lori lightfoot says her city is now dealing with a crisis. after receiving another bus of roughly 50 migrants from texas this weekend. and she is slamming governor greg abbott for busing those who have entered the country illegally to sanctuary cities like hers. >> this is creating a human crisis. and treating people without dignity, without respect. it's not what we are as americans. and it's, frankly, another demonstration of unpatriotic

supply. the head of california's power grid wants people to conservative power. >> rotating outages are a possibility today. are now moving into the most extreme part of this heat wave and really stepping up those actions here today and tomorrow in particular are going to be essential to helping us maintain reliability. >> with strains on california's power grid at hand, more doubts about how the state will handle an electric car mandate by the year 2035. 1 states are already weighing plans to adopt california's electric vehicle mandate but not everyone is on board. minnesota's governor said in a statement, quote: we are not california. minnesota has its own plan. our priority is to lower costs and increase choices so minnesotans can drive whatever vehicle suits them. critics say the electric vehicle mandate just doesn't make sense. >> how much more demand is there going to be if everybody is having to plug in an electric vehicle and how much more chaos could this potentially unleash given what we have already seen of the wobbly california power

jeff, there is two different on the democratic side. >> by the senate there is. the polling underscores that morgan is right. and you are right to say it's still very early. a lot can happen between now and november. but, if you look at the toss-up races or some of the race that were considered toss-ups that are now moving at least according to some pollsters into democratic territory, including pennsylvania and including arizona. that is helpful for dems when they look at the senate. i think the house is a different story. there seems to be a little bit more confidence on the democratic side that they have a shot at holding the house. but, i think that was going to be a tougher call. >> bret: they don't have that many seats to pick up in redistricting effects a number of those states. "u.s.a. today," hugh, asset or liability. hasn't led to new invitations on campaign trail. he has three trips to pennsylvania, wisconsin and ohio later this week. >> well, the earlier number that morgan put out 70% wrong

direction, that's the key. lagging indicators are polls. i don't think so much of polls. i do look at races in the senate and i feel much better among than i did a month ago. herschel walker is caught and surpassed raphael warnock in georgia not by a lot but by a little. people generally like herschel. i look out in arizona. blake masters closed within 4 points. mark kelly sat risk of getting caught. i think dr. oz has a lot of momentum meanwhile new states come into play in the senate race, especially colorado with joe owe district attorney. o'day.all tolled, the presidentw everything into this student loan bailout. and it blew up in his hands. he tried again with that speech in philadelphia. it blew up in his hands. he is out there trying as best he can but there is a reason people don't show up with him, bret, because he is an anchor on the electability. while i think it's a good thing for democrats say going to win
